Gugatan Wanprestasi

Sebagaimana dijelaskan pada artikel sebelumnya mengenai jenis gugatan secara umum di Indonesia, pada artikel kali ini membahas mengenai perjanjian/kontrak secara umun dan gugatan wanprestasi atau gugatan ingkar janji karena tidak terpenuhinya suatu perjanjian (kontrak).

Kontrak bisnis secara umum mengacu pada ketentuan KUH Perdata, yang mengatur secara rinci mengenai perjanjian, syarat sah perjanjian, serta akibat hukum batalnya perjanjian.

Penerapan UU Ciptaker dan UU No. 13 Tahun 2003

Penerapan UU Ciptaker masih memerlukan penyesuaian setelah Pemerintah mengesahkan UU Ciptaker beserta peraturan pelaksanaanya (PP, Perpres) khususnya untuk sektor ketenagakerjaan, namun pada dasarnya UU 13 /2003 tentang Ketenagakerjaan juga masih tetap berlaku sepanjang pasal-pasal yang ada dalam UU 13/2003 tidak diubah atau dihapus oleh UU Ciptaker. Dalam hal ini, ada 31 pasal yang diubah, ada 29 pasal yang dihapus, dan ada 13 pasal baru yang disisipkan. (tabel terlampir).
