Death Penalty on Narcotics Case in Indonesia

This essay based on experience to handle the case on behalf of the defendant AT in Surabaya District Court and the defendant RS in Lubuk Pakam District Court, North Sumatera. Both defendants have been involved on narcotic case and punished with death penalty in District Court and High Court, then in Supreme Court is punished with life sentence. These cases were handled since beginning as regulated under Criminal Procedures Indonesia.

Basically, according to Law No. 35 of 2009 concerning Narcotics (“Narcotic Law”) there are several Articles which stipulated death penalty, Article 113 paragraph (2), Article 114 paragraph (2), Article 116 paragraph (2), Article 118 paragraph (2), Article 119 paragraph (2), Article 121 paragraph (2). As for the Defendant AT is subjected to Article 113 paragraph (2) Narcotic Law, while RS is subjected to Article 114 paragraph (2) Narcotic Law.

Business Transaction Without Contract

In the business transaction, the parties usually make a written agreement to anticipate if there is a dispute in the future related to business transaction, where the written agreement aims to protect the rights of the parties if one party defaults.

Usually, commercial disputes occur due to negligence of one party, either regarding payment or work that is not in accordance as promised. If so, then the parties will strictly hold to the written agreement that was ever signed.

The term of consent, agreement, or contract basically same because referred to legal basis as stipulated on Civil Code Article 1320:

Dispute Resolution through BANI (Indonesia National Arbitration Board)

Basically, commercial disputes can be proceed through the court or arbitration forums, where both types have different mechanisms and conditions. The mechanism through arbitration forums (generally) refers to the provisions of Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution (“Law No. 30/1999”).

According to the provisions of Article 1 No. 1 Law No. 30/1999 is stated explicitly as follows:

“Arbitration is a method of resolving a civil dispute outside the general court based on an arbitration agreement made in writing by disputing parties“.

Memahami Gugatan Class Action

Gugatan class action telah dikenal pertama kali pada abad ke 17 di Inggris, kemudian meluas penerapannya di abad ke 19 di negara-negara lainnya seperti Amerika Serikat, Kanada, Australia, dan lain-lain, yang pada umumnya adalah negara-negara dengan sistem hukum common law, tetapi bagi Indonesia sendiri pemahaman konsep ini masih terbilang baru.
